Digital Agreement
Parties
This Digital Agreement (“Agreement”) is entered into between you (“User”) and Global V-Secure Services Pvt Ltd (“GVSS”), collectively referred to as the “Parties.”
Acceptance of Agreement
By proceeding with the installation process, you signify your acceptance and agreement to the terms and conditions outlined in this Agreement.
Scope of Services
GVSS provides digital security services aimed at protecting online transactions and ensuring data confidentiality. The specific services offered may vary and will be outlined in separate service agreements or contracts.
User Responsibilities
4.1 User Account
You are responsible for maintaining the confidentiality and security of your account credentials provided by GVSS. You agree not to share your account information with third parties or allow unauthorized access to your account.
4.2 Compliance with Laws and Regulations
You agree to use the services provided by GVSS in compliance with all applicable laws, regulations, and industry standards. You acknowledge that any illegal or unauthorized use of the services is strictly prohibited.
4.3 Annual Fee and GPS Tracker Device
If you fail to pay your annual fee, GVSS reserves the right to claim ownership of the GPS tracker device and associated SIM card after one week from the fee’s expiration. If the client does not submit the fee or GPS tracker device within this timeframe, GVSS will replace the SIM card. After this point, the company will not be able to provide any services like live tracking. Even if you decide to make the payment after the SIM card replacement, please note that we will not be able to activate the tracking services until your vehicles are brought to our facility. This is essential to ensure that the new SIM cards are installed and functioning correctly.
4.4 Vehicle Installation
If you have to install a tracker on your vehicle, we reserve the right to block all your accounts until this matter is addressed.
4.5 Technical Issues
If the GPS tracker experiences any electronic device faults or technical problems, the client can avail of the vehicle for troubleshooting and issue resolution. GVSS is not responsible for any problems arising from the inability to use the vehicle during this time. Our company provides GPS tracking services and does not insure the vehicle. We solely provide location data in case of theft or other incidents. Additionally, in the case of any technical issue, the company will charge maintenance fees for troubleshooting and resolving the issue.
4.6 Whitelisting
The Company will whitelist the “Just Up” location as long as the tracker is connected. If the tracker is removed, the company is not responsible for claiming or recovering your vehicle/fleet.
Limitations of Liability
GVSS shall not be liable for any direct, indirect, incidental, consequential, or exemplary damages resulting from your use of the services or any third-party actions. GVSS does not guarantee the uninterrupted or error-free operation of its services and shall not be held responsible for any loss or damage arising from service interruptions or errors.
Term and Termination
This Agreement shall remain in effect until terminated by either party. Either party may terminate this Agreement by providing written notice to the other party. Upon termination, you shall cease all use of GVSS services, and any remaining obligations and provisions of this Agreement shall continue to apply.
Governing Law and Jurisdiction
This Agreement shall be governed by and construed in accordance with the laws of the jurisdiction in which GVSS is registered. Any disputes arising out of or in connection with this Agreement shall be subject to the exclusive jurisdiction of the courts in that jurisdiction.
